Synopsis

The history of gay people in Scotland is marked by a complex interplay of legal, social, and cultural developments. Prior to the 1980 release of the Wolfenden Report, which recommended the decriminalization of homosexual acts in private, same-sex relationships in Scotland were illegal under British law. In 1981, the Criminal Justice (Scotland) Act partially decriminalized male homosexual acts, but only between consenting adults over the age of 21 in private, a higher age of consent than for heterosexual activity. This disparity remained until 2001, when the age of consent for same-sex male relationships was lowered to 16, aligning it with the age for heterosexual relationships. Female same-sex relationships were never criminalized in Scotland, though they were often stigmatized and invisible in public discourse. The 2004 Civil Partnership Act extended legal recognition to same-sex couples, and in 2014, Scotland became the first country in the UK to legalize same-sex marriage through the Marriage and Civil Partnership (Scotland) Act. Throughout this history, Scottish cities such as Edinburgh and Glasgow have played significant roles in the development of LGBTQ+ communities, with cultural events, advocacy groups, and media contributing to greater visibility and rights.
